Letter to Congresswoman Michele Bachman

Dear Congresswoman Bachman:

You recently made the following comments, on air, on the Sean Hannity Radio Show:

“At this point the American people – it’s like Thomas Jefferson said, a revolution every now and then is a good thing. We are at the point, Sean, of revolution. And by that, what I mean, an orderly revolution — where the people of this country wake up get up and make a decision that this is not going to happen on their watch. It won’t be our children and grandchildren that are in debt. It is we who are in debt, we who will be bankrupting this country, inside of ten years, if we don’t get a grip. And we can’t let the Democrats achieve their ends any longer.”

I would remind you that words, especially from a public official have consequences, and further, point out that 18 U.S.C. § 2385. Advocating overthrow of Government, states in pertinent part:

“Whoever knowingly or willfully advocates, abets, advises, or teaches the duty, necessity, desirability, or propriety of overthrowing or destroying the government of the United States or the government of any State, Territory, District or Possession thereof, or the government of any political subdivision therein, by force or violence, or by the assassination of any officer of any such government; or

Whoever, with intent to cause the overthrow or destruction of any such government, prints, publishes, edits, issues, circulates, sells, distributes, or publicly displays any written or printed matter advocating, advising, or teaching the duty, necessity, desirability, or propriety of overthrowing or destroying any government in the United States by force or violence, or attempts to do so; or

Whoever organizes or helps or attempts to organize any society, group, or assembly of persons who teach, advocate, or encourage the overthrow or destruction of any such government by force or violence; or becomes or is a member of, or affiliates with, any such society, group, or assembly of persons, knowing the purposes thereof—

Shall be fined under this title or imprisoned not more than twenty years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.”

I believe your actions constitute advocating the duty, desirability, or propriety of overthrowing or destroying the United States government. The use of the word “orderly” does not provide a legal shield, as the “orderly” changing of government happens during elections, of which there has recently been one.

Unless you can offer a reasonable explanation for this call to overthrow the current government, it is my intention, as a proud citizen of this country, to formally request that the local State Attorney here, and the United States Attorney immediately launch investigations into your treasonous rhetoric.
